BreezeStay operates as a technology platform and facilitator. Stays are governed by a Leave & License model, with agreements executed directly between Host and Renter.

Operational Directives

1. Platform Facilitator Role

  • BreezeStay operates strictly as a digital marketplace aggregator and facilitator connecting renters and property owners.
  • BreezeStay does NOT own, operate, manage, or lease physical properties directly.
  • The Leave & License agreement is executed directly and independently between Host (Licensor) and Renter (Licensee).
  • BreezeStay provides the digital booking tools, automated document templates, verification checks, and dispute mediation assistance.

2. Nature of Occupancy

  • All bookings and stays executed via BreezeStay are strictly Leave & License agreements, not tenancies.
  • No permanent tenancy or occupancy rights are created under Indian local rent control regulations.
  • Occupancy is temporary, non-transferable, and subject to contractual termination rules.

3. Agreement Formation & KYC Verification

  • Digital Leave & License agreements are automatically generated upon successful Aadhaar/PAN KYC checks (compliant with aggregator fraud directives).
  • The generated agreement details both parties’ identities, rental fees, security deposit amounts, and license terms.
  • Consent is gathered via OTP or active click-wrap confirmation, establishing a legally valid digital agreement under India’s IT Act, 2000.

4. Stamp Duty & Registration Compliance

  • Under applicable state rent controls, Leave & License agreements may require mandatory registration and stamp duty payment.
  • Stamping, registration fee processing, and legal submission are the joint contractual obligations of the Host and Renter.
  • BreezeStay provides digital draft templates but does not directly execute local registration services.

5. License Duration & Renewal

  • Standard digital license agreements are configured for a duration of up to 11 months.
  • Renewals are subject to mutual consent and must be executed through the platform to maintain secure status.
  • The license automatically expires at the end of the term unless actively renewed.

6. Payment Structure & Verification

  • Bookings start as pending-payment. Renters must upload payment proof (UPI, bank transfer receipt) within the designated active window.
  • BreezeStay administrators verify the uploaded payment proof before updating status to confirmed. All approvals are audit-logged.
  • Bookings with unverified or missing payment proofs automatically expire to release host inventory.

7. Tax Compliance & HRA Support

  • The Host’s verified PAN is embedded directly in invoices and agreement drafts.
  • BreezeStay generates downloadable, compliance-ready HRA receipts for corporate tax claims.
  • All parties are independently responsible for filing income tax returns and other direct tax liabilities.

8. Utilities & Operational Charges

  • Unless explicitly stated otherwise in the booking, utilities (electricity, water, internet) are the renter’s responsibility.
  • Structural maintenance, property taxes, and society maintenance charges are strictly the host’s liability.

9. Property Usage Limits

  • The renter must utilize the property exclusively for private residential occupancy.
  • Illegal activities, commercial usage, or causing community nuisance are grounds for immediate license termination.
  • Violations lead to check-out execution and account suspension.

10. Subletting & Assignments

  • Subletting, license transfer, or adding secondary occupants without host approval is strictly prohibited.
  • The agreement is personal and non-transferable.

11. Structural Damage & Audits

  • No structural alterations or heavy drilling are permitted without prior written consent from the host.
  • Accidental damages must be repaired by the renter or compensated at check-out.
  • Deposit claims must be verified against the check-in audit visual files.

12. Inspection Access

  • Hosts may enter the property for inspection or structural repairs only after giving reasonable prior notice.
  • Immediate access is permitted in case of emergency (fire, water leakage, or safety threat).

13. Move-in & Move-out Protocols

  • Renters must complete the 24h Move-in Audit to establish a baseline condition record.
  • At termination, the renter must return the property in the same state, excluding normal wear and tear.

14. Termination & Notice Period

  • Standard terminations require a dashboard notice filing, typically 30 days prior, unless mutual cancellation is approved.
  • Immediate terminations apply for code violations, payment defaults, or safety breaches.

15. Vacating & Unauthorized Holdover

  • Renters must vacate and clear all personal belongings immediately upon license expiration or termination.
  • Continued occupancy without consent is unauthorized and subject to daily holdover penalties.

16. Digital Consent Validity

  • Digital signature, OTP checks, and active click-wrap confirmations represent binding execution.
  • Physical agreements are not required unless demanded by local registration authorities.

17. Dispute Resolution & Mediation desk

  • BreezeStay provides mediation tools to resolve renter-host disputes but does not hold legal arbitration power.
  • Legal disputes remain between the signing parties. BreezeStay reserves the right to freeze accounts and listing access.

18. Liability Disclaimers

  • BreezeStay is not liable for structural defects, personal injuries, utility failures, or theft inside the licensed property.

BreezeStay is a brand name and technology facilitator operated by Jigyasu Singh Chouhan. It is currently in a pre-incorporation stage and is not a separate legal entity. These policies align with the Digital Personal Data Protection Act, 2023, and Consumer Protection (E-Commerce) Rules, 2020.
