Detailed Rules — Everything You Need to Know

1. Platform Role

  • BreezeStay is a digital marketplace aggregator and facilitator — not a broker.
  • We do not own, operate, manage, or lease physical properties.
  • The Leave & License agreement is executed directly between the Host (Licensor) and Renter (Licensee).
  • BreezeStay provides digital booking tools, automated agreement templates, verification, and dispute mediation assistance.

2. Nature of Occupancy — Leave & License, Not Tenancy

  • All bookings made through BreezeStay are strictly Leave & License agreements — not tenancies.
  • No permanent tenancy or occupancy rights are created under Indian rent control laws.
  • Occupancy is temporary, non-transferable, and subject to contractual termination rules.
  • This is legally significant — the owner can reclaim their property upon agreement expiry without a court order.

3. Agreement Formation & KYC Verification

  • A digital Leave & License agreement is auto-generated after the renter and host complete identity verification (document upload reviewed by our team, plus OTP-based email/phone confirmation).
  • The agreement includes both parties' identities, rent, deposit, duration, and terms.
  • OTP-based and click-wrap consent constitutes a legally valid digital signature under the IT Act, 2000.
  • A physical agreement is optional — required only if local registration authorities demand it.

4. Stamp Duty & Registration

  • Depending on state-specific rules, Leave & License agreements may require stamp duty and registration.
  • The joint responsibility for stamping and registration lies with the Host and Renter — not BreezeStay.
  • BreezeStay provides digital draft templates but does not directly execute local registration.
  • Example: In Maharashtra, agreements exceeding 11 months must be compulsorily registered.

5. Agreement Duration & Renewal

  • Standard digital agreements are configured for up to 11 months (avoiding mandatory registration in most states).
  • Renewals require mutual consent and must be executed through the platform.
  • The agreement automatically expires at the end of the term if not actively renewed.

6. Payment Process & Verification

  • When a booking is created, its status is "pending payment". The renter must upload payment proof within 2 hours.
  • Admin verifies the payment — the booking moves to "confirmed" only after verification.
  • Unverified bookings auto-expire and the property is released.
  • Accepted modes: UPI, NEFT, IMPS, bank transfer. Cash is accepted only in exceptional cases.

7. Tax Compliance & HRA Support

  • The host's verified PAN is automatically embedded in invoices and agreement drafts.
  • BreezeStay generates HRA-compliant digital rent receipts for corporate tax claims.
  • Both parties (host and renter) are independently responsible for their income tax filings.
  • GST does not apply to platform use — applicable tax laws on rent amounts remain the parties' responsibility.

8. Utilities & Operational Charges

  • Unless explicitly stated in the listing, electricity, water, and internet costs are the renter's responsibility.
  • Structural maintenance, property tax, and society charges are strictly the host's liability.
  • Utility bills and meter readings should be transferred to the renter's name at the time of move-in.

9. Property Usage

  • The property must be used exclusively for private residential occupancy.
  • Illegal activities, commercial use, or causing community nuisance are grounds for immediate license termination and ban.
  • Violations result in check-out execution and account suspension.

10. Subletting & Assignment — Not Permitted

  • Subletting, license transfer, or adding occupants without the host's written permission is strictly prohibited.
  • The agreement is personal and non-transferable.

11. Structural Damage

  • Structural changes, heavy drilling, or major modifications are not allowed without prior written consent from the host.
  • Accidental damage must be repaired by the renter or compensated at checkout.
  • Deposit deductions must be reviewed and approved by BreezeStay support based on evidence submitted by the host — pre-existing damage cannot be deducted.

12. Host's Right to Inspect

  • The host may enter the property for inspection or repairs only after giving reasonable prior notice.
  • Immediate access is permitted in emergencies (fire, water leakage, safety threat).
  • Unexpected entry without renter consent is a violation of the license terms.

13. Move-In & Move-Out Protocol

  • We recommend renters independently take timestamped photos and videos of the property at move-in and keep them for their own records — this is not currently a platform-enforced requirement, but supports your case if a dispute arises later.
  • At move-out, the property must be returned in the same condition, excluding normal wear and tear.
  • A 30-day advance notice must be filed via the dashboard to initiate termination.

14. Termination & Notice Period

  • Standard terminations require 30 days' advance notice filed through the dashboard.
  • Immediate termination applies for code violations, payment defaults, or safety breaches.

15. Vacating — Unauthorized Holdover

  • The renter must vacate and clear all personal belongings immediately upon license expiry or termination.
  • Unauthorized holdover is subject to daily penalty charges and potential legal action.

16. Dispute Resolution

  • BreezeStay provides mediation tools for renter-host disputes — we do not hold legal arbitration power.
  • Legal disputes remain between the signing parties. The platform may freeze accounts and listings during investigation.

17. Liability Disclaimers

  • BreezeStay is not liable for structural defects, personal injuries, utility failures, or theft within the licensed property.
  • BreezeStay is a marketplace — not a physical property management service.

Agreement Validity

OTP-based or digital consent is a legally valid signature under the IT Act 2000.

Dispute Scope

BreezeStay mediates disputes — legal parties are the host and renter, not the platform.

Policy Updates

Material changes will be notified via email. Continued use of the platform constitutes acceptance.

Statutory India Compliance Disclosure

BreezeStay is a brand name and technology facilitator operated by Jigyasu Singh Chouhan. It is currently in a pre-incorporation stage and is not a separate legal entity. These policies align with the Digital Personal Data Protection Act, 2023, and Consumer Protection (E-Commerce) Rules, 2020.
